THESE ARE THE LEGALLY BINDING TERMS AND CONDITIONS YOU WILL ENTER INTO WITH THE OWNER LESLEY SOULSBY IF YOU BOOK A HOLIDAY RENTAL AT WOODYHYDE COURTYARD
The person booking the holiday must be one of the guests who will be sleeping at the accommodation and as party leader you will entering into a binding Contract that is subject to these terms and conditions. As the party leader who has entered into this Contract you must therefore appreciate that you will be personally liable for the conduct of all guests and for ensuring that the terms of this agreement are not breached. So for example, if damage is caused at the property, you will be liable regardless of which guest causes the damage.
Once you have made an on-line booking and paid the deposit we will send you an email confirming receipt of the same. The Contract only becomes binding on transmission of that email to you.
Unless agreed with us in advance the number of guests visiting the property must be as stated on the booking form and must not exceed the maximum number of guests allowed as detailed in the property description. Bookings are not accepted from single sex groups unless you have contacted us first to discuss the nature of the group of guests and we have expressly agreed to accept a booking.
Payment of 30% of the total booking fee is payable as a deposit when the booking is placed using our secure online payment system. The full balance for the booking must then be paid not less than eight weeks prior to the start date of the holiday. If a booking is made within eight weeks of the start date of the holiday the full price of the holiday will be payable on booking.
The booking is a binding agreement and regardless of the circumstances of the party leader or any intended guest the full balance due must be paid on or before the due date and there is no legal entitlement to withhold payment or seek reimbursement of any payments that have been made. However, where a cancellation becomes necessary we will make the property available for rebooking and where a rebooking is achieved a refund will be given subject to retention of a fee equal to 15% of the agreed price payable for the holiday. Following a cancellation if it is appropriate to discount the advertised price for the period of the booking we can in our absolute discretion reduce the advertised price in order to try and assist by securing a rebooking but where this is necessary there shall also be deducted from any rebate due to the party leader the difference between the total fee paid or that would have been payable for the holiday by the party leader and the discounted price for the rebooking.
Guests are strongly advised to take out appropriate holiday cancellation insurance that is suitable to their requirements.
We will only cancel the booking if this becomes essential because of circumstances outside of our control such as significant damage to the property that cannot be remedied prior to the commencement of the holiday. Where this is necessary there will be a full refund of all sums paid by the party leader but we shall not be liable for any other consequential losses.
It should be noted that no rebate will be given if guests are unable to attend the property regardless of reason. An example would be if inclement weather or transport problems prevent or delay arrival. Guests are advised to check that their holiday insurance arrangements cover such eventualities.
COVID19 - If it is necessary for you to cancel because regulations prevent the use of our accommodation or prevent you from using our accommodation then you will be entitles to reschedule (subject to availability) or receive a full refund.
The property is large and we always wish to ensure that it is well cleaned and prepared prior to any visit. You should not arrive at the property on the date of commencement of your holiday before 3 pm. On the date of departure it is essential that all guests vacate by 10 am.
Dogs and other pets are not allowed. Please liaise with us in advance if any member of the party uses an assistance dog.
Smoking is not permitted anywhere inside the property.
The party leader will be responsible for all damage to the property and contents. We do however understand that minor accidents will occur so for example we do not charge for items such as broken glasses or crockery. To assist us in ensuring that any broken items are replaced or any damaged items repaired, please ensure that on departure you leave a note for us detailing such issues. This will help us ensure the property is in good order for the next guests.
It should be remembered that the party leader will be liable for all damage caused by all guests including children. For guests staying in Woodyhyde Courtyard that has the leisure facilities. Children aged under 16 are not allowed to use the gym equipment. The swimming pool and sauna are not supervised and these facilities must not be used by children under the age of 16 unless accompanied by an adult. It is strictly forbidden for any guest to take any food, drink, glassware or bottles in to the swimming pool area. If this condition is breached and any broken glass is found in the pool area this might make it necessary for the pool to be drained meaning the pool is not available for use. Where this or any other breach of these conditions result in compensation being paid to subsequent guests the party leader will be liable to keep us fully indemnified in respect of such costs.
These terms and conditions shall be interpreted in accordance with the Law of England and in the event of any dispute the Courts of England shall have exclusive jurisdiction.
